Litigation
Sometimes partnerships dissolve, or do not end the way you envisioned it when the business began or you got married. We do encourage arbitration/mediation prior to stepping into litigation. We understand that sometimes personal emotions get the best of anybody, and having an outside party help determine what is reasonable and fair, is much easier than trying to present your case to someone that is no longer open to what you have to say.
There are neutral appraisals that involve both parties receiving the appraisal. Discovery will be simple. Both sides are informed as the appraisal progresses. This is very time consuming and will likely cost more due to the level of difficulty of maintaining the “same story” from both sides.
Other times, it may be best to order the appraisal through an attorney. Sometimes this is simply the best way to move forward during a tough situation.
